Emotional Support Animals: Illinois Landlord Guide

I’m Mike Fisher with MF CashFlow Property Management, part of M Property Group LLC, a Licensed Illinois Real Estate Broker. This one trips up a lot of good landlords: emotional support animals. Illinois landlords across the south and west suburbs are running into these requests more and more, and a wrong move here can land you in a fair housing complaint fast. Those aren’t cheap to get out of, so let me break this down plain and simple.

Quick side note: ESAs are different from service animals. Service animals under the ADA are trained to perform specific tasks for a person with a disability, like a guide dog.

What Illinois Landlords Can Actually Ask For

You’re not completely without options. If a disability isn’t obvious, you can ask for documentation. You don’t need a diagnosis. You don’t need medical records.

When You Can Say No

You do have some ground to stand on. You can deny an ESA request if the specific animal poses a direct threat to health or safety that can’t be reduced with other measures. And I mean a real, documented, individualized threat, not just “I’m not comfortable with large dogs.” You can also deny if the accommodation would cause you genuine undue hardship, though that’s a high bar for most residential landlords.

What you cannot do is apply a blanket policy. You have to actually look at the request, the specific animal, and make an individualized call. That’s the step people skip, and it’s where the complaints come from. Every request deserves its own honest look.

Damage Is Still on the Tenant

Here’s the good news. The key is protecting yourself before anything happens. Document the unit thoroughly at move-in with photos and a signed condition checklist. If there’s real damage at move-out beyond normal wear and tear, you can deduct from the security deposit.

This is exactly why a solid tenant screening process and a well-documented move-in matter so much. You want a clear paper trail before anything goes sideways. Get that documentation right from day one and you’re in a much better position if you ever need to make a claim.

FAQ: Emotional Support Animals and Illinois Landlords

What if I think the ESA documentation is fake or from an online mill? You cannot demand a diagnosis or full medical records. If you’re genuinely unsure whether to approve or deny a request, talk to a licensed Illinois real estate attorney before you act. That consult costs a lot less than a fair housing complaint.

Let’s Talk About Your Rental

After 35 years investing in real estate and working with owners across the Chicago south and west suburbs, I’ve seen these situations play out in a lot of different ways. The landlords who get burned are usually the ones who made a gut call without knowing the rules. If you’re managing your own property and want to make sure you’re doing things right, start with a free rental analysis to see what your property could actually be earning. And if you want to see what professional management looks like compared to what you’re doing now, check out what management costs and run the numbers. Either way, book a call with me. Let’s talk through your situation and figure out if we’re a fit.
